You agree to independently verify critical information before signing any lease or making any financial commitment.

3.1 No Guarantee of Availability

Properties displayed on the Site may become unavailable at any time. Listing availability is subject to change without notice.

4. User Conduct & Prohibited Activities

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. The following activities are strictly prohibited:

• Posting false, misleading, fraudulent, or deceptive rental listings or inquiries.
• Harassing, abusing, or threatening other users, landlords, or property managers.
• Attempting to bypass any security features, scrape data, or use bots/automated tools.
• Uploading malicious code, viruses, or any material that could harm the Site or other users.
• Using the Site for any commercial purpose without our prior written consent (including resale of listing data).
• Discriminating against any person based on race, colour, religion, gender, disability, family status, or any other protected characteristic under Canadian Human Rights law.

YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AFFORDABLERENTALS CANADA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AFFORDABLERENTALS CANADA, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE SITE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $100 CAD OR THE AMOUNT YOU PAID US (IF ANY) IN THE PAST SIX MONTHS.

9. Indemnification

You agree to indemnify, defend, and hold harmless AffordableRentals Canada and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from (a) your violation of these Terms; (b) your use of the Site; (c) any interaction or dispute between you and any landlord, tenant, or third party; or (d) your violation of any applicable law or regulation.

10. Privacy & Data Collection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Site, you consent to the collection and use of information as described in the Privacy Policy, including transfer of data to our service providers for operational purposes (e.g., Zoho SMTP for inquiries).

11. Termination & Suspension

We reserve the right, without notice and in our sole discretion, to terminate or suspend your access to the Site, remove any user content, or block your IP address for any reason, including but not limited to violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively through binding arbitration in Toronto, Ontario, in accordance with the rules of the ADR Institute of Canada. You agree to waive any right to a jury trial or to participate in a class action. Small claims court actions may be brought instead of arbitration at your option, provided the claim falls within its jurisdiction.
